Introduction

Qi Teas is the brand name wholly owned by Herbal Health Ltd in the UK, there are other distributors/companies selling the Qi Teas brand on their own sites under their own company names. We take our responsibility to protect your privacy very seriously. That’s why we promise to never release your personal information to any third party company for their mailing or marketing purposes when you make a purchase on our website, or sign-up for Qi Teas - Herbal Health Ltd marketing.

Like many companies we outsource some of our marketing and social media management - FES Enterprises are the sole third party to which we entrust any of our customers data for marketing purposes and you can view their privacy policy (which is also dedicated to ensure the proper handling and use of your data) here.

This Privacy Notice explains how we may collect, use, process, share, and store personal information about you, including through designated third-party service providers, and the choices that are available to you regarding this information.

 Please read this Privacy Notice carefully to understand our views and practices regarding your personal information and how we will treat it. 

There are a number of independent distributors of the Qi Teas - Herbal Health Ltd brand internationally. These companies are independent of Qi Teas - Herbal Health Ltd, they operate under their own brands with separate and independent policies and procedures. We never share your information with them for marketing or other purposes nor do we receive any customer data from them regarding to sales of our product or merchandise.

In addition to any information kept in hardcopy, this Privacy Notice also applies to online applications that run on smart phones, tablets, mobile devices (“apps”), and other online services that we offer which link to this Privacy Notice. Please note also that our websites may contain links to other websites which operate under their own Data Protection policies and procedures.

What information do we process?

Only information you voluntarily give to us. When you shop on our website we collect information relevant to your purchase. This allows us to send your order, contact you in relation to your order (for example if your order is lost, an item is out of stock, payment hasn’t cleared etc.) and to pass your payment information onto our processing partners PayPal and Sage Pay.

All of this information is stored securely and we comply with all applicable data protection and consumer legislation. 

How do we use the information about you?

We collect information about you when you purchase our products and/or merchandise in order to successfully process your order we require your personal data to ensure your purchases are shipped and processed correctly and effectively - this data is provided by you when you set up an account or process an order.  We also collect information about you using cookies if you interact with us via phone, social media, websites, apps or mailing lists. 

The types of information that you may give us vary depending on the specifics of your order. Email addresses, names, address and contact numbers and payment information are standard in order for us to process most orders. We do not use your data for cross purposes. For example we will only use your information for marketing purposes if you have actively signed up to our mailing list via our website. If you place an order and provide us with your personal data this will be used solely to process your order. You reserve the right to contact us and use your right to be forgotten and or unsubscribe to any mailing lists at any time.

The information you may give us could include categories such as, but not limited to, your name, work or personal address, e-mail address, phone number, date of birth, gender, as well as customer data, payment data, employee data and/or website user data. 

Cookies and website usage - We will never hold nor ask for data that is not absolutely essential for the services/products or merchandise you have requested from us. This helps us ensure that we deliver relevant content to you and to better understand what is of genuine interest to you.

You will have to explicitly agree to receive marketing and we aim to never use confusing language. Our websites use cookies to distinguish you from other users of our websites. This helps us to improve the functionality and content of the websites, including keeping our websites and records safe and secure, and to facilitate usage by you.

Please note that our websites are not intended for children under 13 years of age, and we do not knowingly solicit data online from, or market online to, children under 13 years of age. 

Unfortunately, the transmission of information via the internet is not 100% secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to/from our website -- any transmission is at your own risk. Human error is always a consideration.

Information we receive from other sources.

Information we process about you comes voluntarily from you as the consumer. We obtain information about you from social media platforms which are public domain to use for targeting advertising via automatic social media tools.

From time to time we will run competitions in partnership with a third party – always fully vetted by us to ensure they fit with the Qi Teas - Herbal Health Ltd brand and would be of interest to you, our customers.

We ensure wherever possible that all our data from third parties has been obtained in compliance with GDPR Legislation.

We use your information to provide you with information, process orders for products that you request from us, and administer or otherwise carry out our obligations in relation to any agreement you have with us. Qi Teas - Herbal Health Ltd retains your information for the period necessary to serve a legitimate purpose or as required by law.

We may also use this information to provide you with information about goods or services we feel may interest you, to record statistics which relate directly to your or any of our clients company or services via cookies, google analytics, mail chimp and social media. 

If at any time you wish us to stop using your information for any the above purposes, please contact us via our website. We will stop the use of your information for such purposes as soon as it is reasonably possible to do so.

You are able to request and exercise your right to be forgotten at anytime, and all data will be deleted within 30 days. Please note this may infringe upon any on going orders or outstanding payments. 

How do we share your information?

Your information is shared between Qi Teas - Herbal Health Ltd and Frances Clifford/ Emily Foster, owners of FES Enterprises who conduct marketing on behalf of Qi Teas - Herbal Health Ltd. We will never share your information with third parties without your prior consent. These third parties will not use your personal information for any other purposes than what we have agreed to with them, and you, and we request those third parties to implement adequate levels of protection in order to safeguard your personal information.

While the information is under our control, Qi Teas - Herbal Health Ltd seeks to ensure that your personal information receives adequate protection, including seeking to ensure that it is kept secure and used only in accordance with our instructions and for legitimate purposes. 

In the event we go through a business transition, such as a merger, acquisition of another company, or sale of part or all of our assets, we may disclose your personal information to third parties and your personal data held may be among one of the assets transferred. 

We may also automatically collect non-personal information about you such as the type of internet browsers you use or the websites you visit.  We may also aggregate details which you have submitted to us. You cannot be identified from this information and it is only used to assist us in providing effective services, including in connection with our website or those of our customers.

Finally, we may be under a duty to disclose or share your personal information for various other reasons, such as to comply with a legal obligation; to enforce or apply our terms of use and other agreements; or to protect the rights, property, or safety of Qi Teas - Herbal Health Ltd, our customers, or others. This could include, for example, exchanging information with a law enforcement agency or regulator; or with companies and organisations for the purposes of fraud protection and credit risk reduction.

 

With regards to independent companies selling Qi Teas - Herbal Health Ltd products within and outside of the E U. We have issued the following statement to be added to their Social Media platforms and Websites in order to make it clear that they hold their own responsibility for compliance within the GDPR. 

“Dear distributor

In compliance with the new GDPR legislation which came into effect May 25th 2018 we are in the process of updating our privacy policy. As a distributor of the Qi Teas brand we require you to make a small addition to your websites and social media profiles, this addition (found below) is to ensure that all parties, and indeed your own brands are fully protected within the guidelines of the new General Data Protection Regulation, which is applicable to everyone selling or marketing within the EU. GDPR is applicable even if you only have one EU customer.

 

We kindly ask that you incorporate the following statement into any websites and social media platforms which market or sell Qi Tea products (if you are unsure where to incorporate the statement, “about us” sections are usually found on all websites and social profiles).

  

“As a third party distributor/wholesaler of Qi Tea merchandise and products, we work as an entirely separate entity to Herbal Health, owners of the Qi Teas brand. All of the data held by (insert company name) is contained within (company name) We as (Insert company) are the data processor.”Potential rights under the GDPR”

 

Under the EU General Data Protection Regulation (“GDPR”), if you are a citizen or resident of an EU country or Switzerland, you may have certain rights regarding your personal information:

    Right to access information maintained about you; 

    Right to ensure your data is accurate and complete; 

    Right to erasure, or the right to be forgotten;

    Right to restriction or suppression of personal data; 

    Right to data portability;  

    Right to withdraw consent if consent was previously provided; and

    Right to raise a complaint to the Information Commissioner’s Office.
